Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Nomad Pads website, listings, messaging, accounts, and related services (collectively, the "Service") operated by Nomad Pads Operations SAPI de CV ("Nomad Pads," "we," "us," or "our") in Mexico City, Mexico.

By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Nomad Pads is a marketplace platform that connects prospective tenants (including digital nomads, remote workers, and expats) with property owners who list furnished short- and medium-term rentals in Mexico City (CDMX).

Our role is to help you discover listings, inquire about availability, and coordinate introductions between tenants and owners. We are not a hotel, not an Airbnb substitute for nightly stays as our primary product, and not a traditional 12-month local brokerage.

We do not sell your personal data. We use account and inquiry information only to operate the Service and to connect you with relevant properties and the other party to a potential rental (see our Privacy Policy).

Tenants / renters.You may browse public listings, create an account, message about a property, and pursue a rental with an owner. Move-in requirements for partner listings are typically ID, first month's rent, and a deposit — unless an owner states otherwise for a specific unit.

Owners / landlords. You may create an owner account, list furnished properties, set pricing and availability, and communicate with prospective tenants. You are responsible for the accuracy of your listing, legal authority to rent the property, and compliance with Mexican law.

Platform. Nomad Pads provides tools and coordination. Unless a separate written agreement says otherwise, the lease is between the tenant and the property owner (or their authorized representative). Listing content is provided by owners; we may review, edit for clarity, or remove listings that violate these Terms or our policies.

You must be at least 18 years old and able to enter into a binding contract to use the Service. You represent that the information you provide is accurate and that you will keep it up to date.

If you create an account, sign in with a third-party provider, submit a property inquiry, or message another user, you are responsible for maintaining the confidentiality of your credentials and for activity under your account.

You agree not to submit false, misleading, or fraudulent information; not to harass other users; and not to use the Service for any unlawful purpose, including unauthorized access to accounts or data.

Messages and inquiries may be shared with the other party to a potential rental (and with Nomad Pads support) so we can facilitate the match. Do not send sensitive payment credentials through messaging.

Listings, photos, amenities, prices, and availability are informational and may change. We do not guarantee that any unit will remain available, that an inquiry will result in a lease, or that published prices are final until confirmed in writing by the owner.

Owners set their own terms. Some owners may request additional requirements (for example a póliza de arrendamiento). Nomad Pads' default marketing position is that fiador and póliza are not required for many partner listings — always confirm requirements for the specific property before you commit.

A rental relationship is formed only when the tenant and the applicable lessor execute a separate written lease or agreement. Rent, deposit, duration, utilities, early exit, and termination are governed by that document and applicable Mexican law — not by these Terms alone.

Unless we expressly collect funds as part of a written arrangement, payments are typically arranged between tenant and owner. Nomad Pads is not responsible for funds sent outside channels we authorize in writing.

Depending on the listing and owner, we or the owner may request identity documents or other information to evaluate a stay. Approval is discretionary. Meeting general platform criteria does not guarantee acceptance of any application or inquiry.

The Service — including Nomad Pads branding, site design, and original content — is owned by Nomad Pads or its licensors. Listing photos and descriptions may be owned by property owners or their licensors; by uploading content, owners grant us a license to display it on the Service for marketing and matching purposes.

You may not scrape, copy, or redistribute the Service or listing content at scale without our prior written consent.

The Service may integrate authentication (e.g. Google), maps, email, cloud storage, or analytics providers. Those services are governed by their own terms. We are not responsible for third-party content or practices.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THE CONDITION OF ANY PROPERTY OR THE CONDUCT OF ANY USER.

TO THE FULLEST EXTENT PERMITTED BY LAW, NOMAD PADS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR FROM INTERACTIONS WITH OTHER USERS.

Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim or (b) one hundred U.S. dollars (USD $100), except where applicable law requires otherwise.

You agree to indemnify and hold harmless Nomad Pads from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your listings or inquiries, your violation of these Terms, or your violation of any rights of a third party.

We may update these Terms from time to time. We will post the revised version on this page and update the "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Mexico, without regard to conflict-of-law principles. Courts in Mexico City, Mexico shall have exclusive jurisdiction over disputes arising from these Terms or the Service, unless mandatory law provides otherwise.
